TERMS AND CONDITIONS OF SALE

PAYMENT

Payment on credit accounts is due for receipt by Technical Rigging Services on the 20^th day of the month following date of invoice, provided that if the Purchaser defaults upon any payment so required in respect of any order then payment shall be immediately due for all goods that have been delivered to the Purchaser.  All costs of collection will be bourne by the Purchaser.

INTEREST

Technical Rigging Services reserves the right to charge interest at the rate of 2.5% per calendar month or part thereof on any account remaining unpaid at the due date. In addition, Technical Rigging Services reserves the right to claim all costs incurred recovering overdue accounts.

DISCOUNTS

Any discounts applying from time to time shall only be deductible if payment terms are strictly met.  No discounts will be granted unless payment is received by Technical Rigging Services on or before the due date.

CREDIT ACCOUNTS

The Purchaser acknowledges that Technical Rigging Services has the absolute right to cancel the Purchaser’s credit at any time before accepting any order and without notice to the Purchaser, and to require payment in cash for any order if Technical Rigging Services, at it’s sole discretion, thinks fit.

RETURNS

Goods cannot be returned by the Purchaser unless expressly agreed by Technical Rigging Services.  If so agreed, a restocking charge of 10% of the invoiced price shall be chargeable to the Purchaser.

RISK

Goods supplied by Technical Rigging Services are at the Purchasers risk from the time such goods are delivered to or as directed by the Purchaser or into custody on the Purchaser’s behalf.

RESERVATION OF TITLE

Ownership in all goods supplied shall remain with Technical Rigging Services until the Purchaser has paid for them and for all other goods delivered by Technical Rigging Services to the Purchaser.  Without prejudice to any other rights, Technical Rigging Services shall be entitled to recover possession of, and may dispose of, the goods in the event of any actual or anticipatory breach by the Purchaser of the obligation to pay for the goods or for any other goods delivered by Technical Rigging Services to the Purchaser, and Technical Rigging Services shall have the right to enter any premises occupied by the Purchaser at any time for that purpose.

LOSSES, DAMAGE OR SHORT DELIVERY

Technical Rigging Services shall not be obliged to accept any claims for losses, damage or short delivery unless:

(a)                 the Carrier’s consignment note or waybill is endorsed at point of delivery; and

(b)                 the claim is made in writing with full particulars and lodged with Technical Rigging Services or the Carrier within seven days of delivery.

PRIVACY ACT 1993

The Purchaser irrevocably authorises Technical Rigging Services NZ Ltd to receive and disclose information to assist credit approval and management of any credit facility granted to the purchaser.  Principal 11(D) of the Act applies ie. “That the disclosure is authorised by the individual/s concerned”.  The customer has rights to the access and correction of information held by Technical Rigging Services NZ Ltd.  The Purchaser authorises any person or company to provide the seller with such information as the seller requires in response to its enquiries.  The Purchaser authorises the seller to furnish to any third party details held by the seller about the Purchaser including any subsequent dealings the Purchaser may have with the seller.
